The Services are designed for employees, HR administrators, and coaches of subscribing organizations. Users must be at least 16 years old. The Services are not directed at children younger than 16.

3. Accounts and Security

You are responsible for maintaining the confidentiality of your account credentials and must report any unauthorized access to your account promptly. We reserve the right to terminate accounts that violate these Terms.

4. Use of Services

You agree to use the Services lawfully and in alignment with your employer's policies. Prohibited activities include:

• Uploading false or misleading content
• Attempting to disrupt or compromise system integrity
• Misrepresenting activity data
• Sharing others' information without their permission

5. Data and Privacy

Our collection and use of personal data is governed by our Privacy Policy. Employers may receive activity reports. Users can opt out of leaderboards and social features at any time.

6. Intellectual Property

All software, trademarks, content, and features of the Services are owned by TFC LLC or its licensors. No copying, reproduction, or creation of derivative works is permitted without prior written consent.

7. Third-Party Services and Integrations

Integrations with Apple Health and Google Fit are subject to the respective third-party terms and policies of those services.

8. Rewards and Challenges

Rewards provided through the Services are not financial incentives or employment benefits. TFC LLC does not handle any associated tax obligations. Fraudulent activity will result in disqualification and account suspension.

9. Service Availability

Continuous availability of the Services is not guaranteed. Features may be modified, suspended, or discontinued at any time with reasonable notice.

10. Disclaimers

The Services are provided for general wellness only and do not constitute medical advice. You should consult a healthcare professional before starting any fitness program. No warranties are made regarding the accuracy or fitness of the Services for any particular purpose.

11. Limitation of Liability

To the fullest extent permitted by law, TFC LLC shall not be liable for indirect, incidental, or consequential damages arising from your use of the Services. Our total liability is capped at the amounts paid by you in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless TFC LLC against any claims, damages, or expenses arising from your misuse of the Services or violation of these Terms.

13. Termination

Breaches of these Terms may result in suspension or termination of your account. Employers may request account termination upon employee offboarding. All rights granted to you under these Terms end immediately upon termination.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Commonwealth of Virginia, United States. Any disputes shall be resolved in the courts located in Norfolk, Virginia.

15. Changes to Terms

Material changes to these Terms will receive 30 days' notice via email or in-app notification. Continued use of the Services after the notice period constitutes acceptance of the updated Terms.
